We first conceptualize regulatory arbitrage—shifting compliance efforts across different regulatory domains—as an overlooked but important strategic response to regulation. We then theorize how regulatory ambiguity shapes firms‘ choices between arbitrage and decoupling—symbolic compliance without substantive change. We argue that low ambiguity (clear, enforceable rules) prompts arbitrage, while high ambiguity encourages decoupling. To test this, we examine mobile App behavior in China following two key events: the 2021 Personal Information Protection Law (the Law), a comprehensive and strictly enforced regulation, and the 2019 Guideline on Illegal App Data Practices (the Guideline), a more ambiguous directive. Using a Difference-in-Differences design with continuous treatment intensity, we find support for our theory. After the Law, highly exposed Apps reduced violations in regulated areas but increased them in unregulated ones—evidence of arbitrage. In contrast, following the Guideline, firms selectively disclosed by obscuring data-collection practices in privacy policies—evidence of decoupling. Our findings contribute to research on regulatory compliance and nonmarket strategy by introducing regulatory arbitrage as a distinct strategic response and by showing how regulatory clarity shapes firms‘ behavioral choices.

 

演讲人简介:

Eva Xie Lingling is a Ph.D. candidate in Strategy and Entrepreneurship at the Lee Kong Chian School of Business, Singapore Management University. She holds both a Master‘s and a Bachelor‘s degree in Economics from Shanghai Jiao Tong University. Eva‘s research lies at the intersection of nonmarket strategy, sustainability, and institutional theory. Her recent work investigates how firms respond to institutional change and uncertainty, focusing on regulatory shocks and social activism in emerging markets. She has received the Best Conference Paper Prize at the 45th Strategic Management Society (SMS) Annual Conference and the Best Paper Award at the 2024 Singapore Rising Scholar Conference (SRSC). Before pursuing her doctoral studies, Eva worked as a management consultant at Roland Berger and Deloitte Consulting, advising clients across sectors such as government, private equity and venture capital, digital platforms, and mobile phone manufacturing.
